Welcome to Underground Universe. Please read these Terms of Service ("Terms") carefully before using our mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
The App is operated by Underground Universe ("we," "us," or "our"), based in Cleveland, Ohio.
You must be at least 16 years old to create an account or use the App.
Anyone who is 15 years old or younger is strictly prohibited from creating an account or using our services.
By creating an account or using the App, you represent and confirm that you are at least 16 years old.
If we learn that an individual under 16 has created an account or is using the App, we may suspend or terminate the account and take reasonable steps to remove associated information.
You retain ownership of the art, music, modeling, dance, performances, visual arts, cosmetics, cooking, photographs, videos, written material, and other content that you create and post through the App ("User Content").
By posting or uploading User Content to the App, you grant Underground Universe a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and technically modify your User Content as reasonably necessary to operate, maintain, and provide the App and its features.
This license does not transfer ownership of your User Content to Underground Universe. You retain ownership of your content, subject to the rights granted in these Terms.
You are responsible for ensuring that you have all rights, permissions, and consents necessary to post or share your User Content.
Underground Universe is a showcase and social platform. We do not guarantee the accuracy, quality, legality, or reliability of User Content posted by users, and we do not endorse statements, opinions, products, services, or other material posted by users.
To help keep Underground Universe safe, you agree not to post content or engage in behavior that violates these rules.

You may only post or share content that you created yourself or that you have the legal right and necessary permissions to use.
You may not upload or distribute another artist's, creator's, photographer's, musician's, or other rights holder's work without authorization.
Certain App features may request access to device permissions, including location services and permission to add pictures to your Photos library.
If you grant the App permission to access your device's location, the App may process your current location to display your current location within the App and provide applicable location-related features.
Depending on the permissions available on your device and the features you use, the App may request permission to access your location while you are using the App or, where applicable, access location information in the background.
You may manage or revoke location permissions through your device settings. If you deny or revoke location access, certain location-related features may not function.
If you choose to save a picture through an App feature, the App may request permission to add your desired picture to your Photos library.
You control whether to grant this permission through your device settings. If you deny the permission, the applicable save-to-Photos feature may not be available.
The App's collection and use of information associated with these permissions is described in our Privacy Policy.
By using the App, you acknowledge that we collect and process information necessary to operate and provide the App, including account information, profile information, User Content, usage analytics, device information, payment-related information, and information associated with device permissions that you authorize.
Our collection, use, storage, retention, and protection of personal information are described in our Privacy Policy.
The Privacy Policy also explains our practices regarding location information, Photos permissions, analytics, data retention, account deletion, privacy rights, and data security.
You are responsible for providing accurate information when creating your account and for maintaining the security of your account credentials.
You may not create an account for another person without authorization or create multiple accounts for the purpose of evading enforcement actions or restrictions.
You are responsible for activity that occurs through your account unless the activity resulted from unauthorized access that was not reasonably within your control.
If you believe your account has been compromised, you should notify us through the App's support or messaging features.
You may request deletion of your account through the App's settings or available account-support features.
When an account is deleted, your profile may first be archived and associated information may be retained for a limited period of up to 180 days before permanent deletion, subject to applicable legal obligations and legitimate business purposes.
Certain information may be retained for longer periods where required by law or where it has been aggregated or de-identified so that it can no longer reasonably be associated with you.
We reserve the right to suspend, restrict, or terminate your account or remove User Content if we reasonably believe that you have violated these Terms, our community standards, or applicable law.
We may take action immediately and, where appropriate, without prior notice when necessary to protect users, the App, or others.
We reserve discretion to determine whether User Content or conduct violates these Terms or our safety and community guidelines.
We may consider the context, severity, frequency, and potential harm associated with content or conduct when determining appropriate enforcement action.
You are solely responsible for the User Content you post, upload, transmit, or otherwise make available through the App.
Underground Universe does not guarantee that User Content is accurate, complete, appropriate, lawful, or safe.
To the maximum extent permitted by applicable law, Underground Universe is not responsible for User Content posted by you or other users, including offensive, inaccurate, misleading, unlawful, or otherwise objectionable material.
However, we reserve the right to remove, restrict, or review content when we believe doing so is necessary to enforce these Terms, protect users, comply with the law, or maintain the security and integrity of the App.
The App is provided on an "as is" and "as available" basis to the maximum extent permitted by law.
We do not guarantee that:
We may modify, suspend, discontinue, or restrict any part of the App at any time.
To the maximum extent permitted by applicable law, Underground Universe and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the App or User Content.
This includes, where permitted by law, losses arising from user interactions, User Content, account suspension or termination, unauthorized access, interruptions, or reliance on information available through the App.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict-of-law principles.
To the extent permitted by applicable law, legal actions arising out of or relating to these Terms or the App shall be brought in the state or federal courts located in or serving Cleveland, Ohio, and you consent to the jurisdiction of those courts.
We may update these Terms from time to time.
When we make material changes, we may provide notice through the App or by other reasonable means.
Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
